**An** **ACT** **To** *Protect and incentivise the production and consumption of uniquely British Foodstuffs* *Be It Enacted* by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Lords, and Commons, in this present Parliament assembled, and by the authority of the same, as follows -\* **Section 1: Apportionment of Protected Status** (1) There shall exist a program intended to protect and preserve products with specific geographic indications, or other traditional specialities, entitled the United Kingdom Heritage Foods (UKHS) program. The Secretary of State may by statutory instrument designate a good as; a Protected Destination of Origin good (PDO), b Protected Geographical Indication good (PGI), or- c Traditional Specialities Guaranteed good (TSG). (2) The Secretary of State shall be required to implement any reasonable request by the Scottish Government, the Welsh Government or the Northern Ireland Executive for a good to be designated under the UKHS if that request is coherent with the existing goods designated under the UKHS. **Section 2: Protected Designation of Origin (PDO)** (1) The Protected designation of origin status shall be determined to be the name of an area, a specific place or, in exceptional cases, the name of a country, used as a designation for an agricultural product or a foodstuff which: (2) which comes from such an area, place or country, (3) whose quality or properties are significantly or exclusively determined by the geographical environment, including natural and human factors, (4) whose production, processing and preparation takes place within the determined geographical area. **Section 3: Protected Geographical Indication (PGI)** (1) The protected geographical indication status shall be determined to be the name of an area, a specific place or, in exceptional cases, the name of a country, used as a description of an agricultural product or a foodstuff which: (a) which comes from such an area, place or country, (b) which has a specific quality, goodwill or other characteristic property, attributable to its geographical origin, (c) at least one of the stages of production, processing or preparation takes place in the area. **Section 4: Traditional Specialities Guaranteed (TSG)** (1) The traditional specialties guaranteed status shall be determined to be the name of a product which: (a) Uses a traditional method of production that clearly distinguishes it from other foods of the same type; (b) Has been produced in this manner for at least 30 years, and passed from generation to generation at least once. **Section 5: Brexit Continuity** (1) Wherein a good was registered by the European Union as a PDO, PGI or TSG prior to the withdrawal of the United Kingdom from the European Union, it will automatically be considered a part of the United Kingdom Heritage Foods program. **Section 6: Actions to be Undertaken by the Government** (1) The Secretary of State is responsible for appointing a commission responsible for recommending the statuses for deserving products. **Section 7: Extent, Commencement, and Short Title** (1) This Act comes into force immediately after Royal Assent. (2) This Act extends to the whole of the United Kingdom. (3) This Act may be cited as the British Heritage Foods Act 2021.
